U.S.A. –-(Ammoland.com)- The Second Amendment Foundation’s federal action against New Jersey Gov. Phil Murphy just expanded as several new plaintiffs have been added to an amended complaint, and their attorneys have filed a show cause motion for a temporary restraining order and preliminary injunction, Ammoland News has learned.
SAF appears to be “leading the charge” in the legal arena, challenging gun store shut-down orders.
Murphy and Callahan are being sued in their official capacities. The case, which was filed in the U.S. District Court for the State of New Jersey is known as Kashinsky v. Murphy.
The lawsuit challenges Murphy’s order shutting down so-called “non-essential businesses” that includes an order to close all gun shops. It resulted in the closure of the State Police background check portal on the agency’s website. It also names State Police Supt. Patrick Callahan as a defendant.
Now joining the SAF lawsuit are the California-based Firearms Policy Coalition (FPC), Legacy Indoor Range and Armory LLC, and private citizens Gina DiFazio, Jontell Platts, Witold Kwiatkowski. They join Racing Rails LLC d/b/a Legend Firearms, the New Jersey Second Amendment Society and Robert Kashinsky.
In addition to noted civil rights attorney David Jensen of New York, Pennsylvania attorney Adam Kraut has joined the legal team.
There is another development in the case. Attorneys representing SAF and its allies have also filed a show cause motion for a temporary restraining order and preliminary injunction.
According to SAF founder and Executive Vice President Alan Gottlieb, the New Jersey lawsuit isn’t the only action on the table. The organization is also planning legal actions challenging “shutdown” orders in California, Colorado, North Carolina, Delaware and Washington State.
While several other state governors have issued so-called “shelter-in-place” orders shutting down many businesses, those orders have identified gun stores and firearms and ammunition suppliers as “essential businesses.”
“Ten years ago,” Gottlieb said in a statement announcing the amended New Jersey complaint, “The U.S. Supreme Court proclaimed that the Second Amendment is not a ‘second-class right’ but it’s being treated that way in New Jersey. The right to keep and bear arms is not subject to the whims of any state official, and it’s time for that message to be delivered clearly by the federal courts.”
There has been no small amount of activity on this front since the COVID-19 “pandemic panic” set in several days ago. Among the more startling was the sudden about-face by Los Angeles County Sheriff Alex Villanueva over the course of 24 hours.
Sheriff Villanueva initially ordered all gun stores in his county to close. However, he reversed course the following day after reportedly learning “that the county’s legal counsel had issued an opinion that such stores were essential businesses,” according to the Los Angeles Times.
That newspaper has also reported that the L.A. County Board of Supervisors “is taking steps to remove Sheriff Alex Villanueva as the head of the county’s emergency operations center during the coronavirus outbreak.” The sheriff called the move a “pure power grab at the worst time possible.”
The Los Angeles Daily News reported that “The county’s counsel, Mary Wickham, said in a statement Tuesday that the county considered gun shops as ‘essential’ businesses during the stay-at-home orders.”
Elsewhere, gun stores remain open in Illinois, Connecticut, Ohio and Rhode Island, according to KUNC News in Greeley, Colo. The Rhode Island situation has caveats, as Gov. Gina Raimondo closed “all recreational facilities, including shooting ranges,” the station reported.
Gun ranges in Washington State have also closed, and at least two cities have considered enacting emergency ordinances with language that would forbid the carrying of firearms. Gun rights advocates say that would violate the state’s 35-year-old model preemption statute and the state constitution’s right-to-bear-arms provision. Here's what Washington State law says:
The state of Washington hereby fully occupies and preempts the entire field of firearms regulation within the boundaries of the state, including the registration, licensing, possession, purchase, sale, acquisition, transfer, discharge, and transportation of firearms, or any other element relating to firearms or parts thereof, including ammunition and reloader components. Cities, towns, and counties or other municipalities may enact only those laws and ordinances relating to firearms that are specifically authorized by state law, as in RCW 9.41.300, and are consistent with this chapter. Such local ordinances shall have the same penalty as provided for by state law. Local laws and ordinances that are inconsistent with, more restrictive than, or exceed the requirements of state law shall not be enacted and are preempted and repealed, regardless of the nature of the code, charter, or home rule status of such city, town, county, or municipality.
The National Shooting Sports Foundation has reportedly asked the White House and Department of Homeland Security, along with governors and local officials “to classify gun and ammunition dealers and manufacturers as essential businesses that must remain open.”
Meanwhile, as Americans hunker down for what could be a “stay home” situation that could last well into the Spring, SAF appears to be leading the charge to challenge any “shut down” order that includes gun shops.

PA GOVERNOR WOLF ADDS FIREARM RETAILERS TO LIST OF APPROVED BUSINESSES DURING CORONAVIRUS PANDEMIC

PA GOVERNOR WOLF ADDS FIREARM RETAILERS TO LIST OF APPROVED BUSINESSES DURING CORONAVIRUS PANDEMIC

U.S.A. –-(Ammoland.com)- Pennsylvania Governor Tom Wolf added gun stores to the list of businesses allowed to stay open during COVID-19 coronavirus restrictions following emergency litigation filed by FPC Law and Joshua Prince of Civil Rights Defense Firm, Firearms Policy Coalition announced today. The Governor’s revised order and related case documents are available at FPCLegal.org.
On March 19, 2020 Governor Wolf released an Order, requiring the closure of all “non life-sustaining businesses.” Included in the list of businesses to be closed were firearms retailers, as apparently Governor Wolf doesn’t consider the Constitutionally guaranteed right to keep and bear arms ‘life-sustaining’. Firearms Policy Coalition’s Director of Legal Strategy Adam Kraut, along with well-known firearms attorney Joshua Prince, immediately challenged Gov. Wolf’s order directly at the Pennsylvania Supreme Court, invoking the Court’s King’s Bench jurisdiction.
While the State’s Supreme Court denied the King’s Bench petition on Sunday, Justice Wecht, joined by Justices Donohue and Dougherty, filed a strongly worded opinion in favor of protecting the right to keep and bear arms. The forced closure of gun shops throughout the entire Commonwealth, they said, was an “impermissible intrusion upon a fundamental constitutional right,” and that local gun shops could make accommodations in the name of social distancing just as other necessary, life-sustaining businesses have done.
Following that guidance, Governor Wolf reversed his gun store ban and published an updated “Industry Operations Guide” which now makes clear that firearms retailers are considered ‘life-sustaining’ and may remain open as long as they practice common public health measures.
“We appreciate that the Governor heard the voices of Justices Wecht, Donohue, and Dougherty and will now allow gun stores to remain open and serve the public,” said Kraut. “The right and ability to protect yourself and your family, particularly in times of crisis, is the very definition of ‘life-sustaining’ and unquestionably protected by both the Second Amendment and the State’s constitution.”
“As we have said before, there is no ‘except in emergencies’ clause in the Constitution and the government cannot shut down the People’s right to keep and bear arms,” said FPC President Brandon Combs. “Our FPC team will continue to fight for the rights of individuals and work to ensure that the People can continue to access and exercise their human rights.”

CINCINNATI, OHIO: COPS WON'T RESPOND TO ASSAULTS OR BREAKING & ENTERING

The new post-apocalyptic world is really something.
While criminals are released from prison, local police forces announce that they won't respond to even serious crimes or make arrests. Meanwhile gun shops are being closed as non-essential. Which pandemic handbook including a chapter on Escape From New York?
Or, in this case, Cincinnati.
Cincinnati police officers will no longer respond in person to the following reports: criminal damaging, dog bites, lost property, lost or stolen license plates, phone harassment, property damage or found property.
Police will no longer respond to assault reports, unless a suspect is still present or the victim requires medical attention, breaking and entering reports unless a suspect is still present, menacing reports "unless suspect is expected or threatens to return or is part of the elements of domestic violence" or theft reports "where there is no possibility of immediate apprehension."
Police are asking victims to report those crimes through the online or telephone reporting system.
Isaac said the announced calls for service do not require dispatch or a physical police response and will be referred for online reporting or telephone reporting when applicable.
On the bright side, the reduced reporting should lower crime rates which will be used to argue that everything is fine.
Except when the homeowner or a business owner actually shoots an intruder in self-defense.

HBO REALITY SHOW TO FEATURE DRAG QUEENS TRAINING "SMALL TOWN" AMERICANS FOR DRAG PERFORMANCE

A new reality show set to premiere on HBO next month features three drag queens who travel throughout small towns in America looking for contestants who they can train to perform in drag for a one-night show.
“We’re Here” features Darius Pierce, who goes by the stage name Shangela; Christopher Caldwell, who goes by the stage name Bob the Drag Queen; and David Huggard, who goes by the stage name Eureka. The three are known from “RuPaul’s Drag Race,” a long-running television series where men in drag compete against each other for the title of “America’s Next Drag Superstar.”
According to the “We’re Here” page on the HBO website, the six-part series follows Pierce, Caldwell and Huggard as they recruit residents from across America and train them to be their “drag daughters” for a one-night performance.
“We travel across this country to take people from who they are to who they can be,” a trailer for the new show states. “We’re actually taking some locals [and] turning them into fierce drag queens.”
The trailer shows some of the selected residents learning how to dress and dance, and some also talk about how they dealt with bullying growing up.
One clip appears to be an interview of a couple whose daughter came out as a lesbian and who now apparently regret their opposition.
“My mom had this look as she thought I would go to Hell,” the daughter states.
In the trailer, drag is described as a “triumph of love over labels,” “electric” and giving one a purpose. When one man is asked how he feels dressed in drag, he replies, “Sexy as [expletive].”
The promotional video ends with a tired Caldwell propping up his feet and stating, “All in a gay’s work.”
HBO has expressed enthusiasm over the series, remarking in a statement, “Drag is about confidence and self-expression. We are so thrilled to showcase the transformative power of the art form with our audience.”
While the show claims, “You can’t live for anyone but yourself,” the Bible teaches that men are to no longer live unto themselves but for Jesus Christ.
“He died for all, that they which live should not henceforth live unto themselves but unto Him which died for them and rose again,” 2 Corinthians 5:15 reads.
In expounding on the verse, the late Bible commentator Matthew Henry once explained, “All were lost and undone, dead and ruined, slaves to sin, having no power to deliver themselves, and must have remained thus miserable for ever, if Christ had not died.”
“We should not make ourselves, but Christ, the end of our living and actions,” he noted. “A Christian’s life should be devoted to Christ. Alas, how many show the worthlessness of their professed faith and love, by living to themselves and to the world!”
Theologian Albert Barnes also outlined, “To live to Him is the opposite to living unto ourselves. It is to seek His honor, to feel that we belong to Him, that all our time and talents, all our strength of intellect and body, all the avails of our skill and toil — all belong to Him and should be employed in His service.”
Jesus said in Luke 9:23, “If any man will come after Me, let him deny himself and take up his cross daily and follow Me.” In Luke 14:27, He added, “And whosoever doth not bear his cross and come after Me cannot be My disciple.”

GOA TO FBI: DON'T SHUT DOWN AMERICA'S ABILITY TO PURCHASE FIREARMS

GOA TO FBI: DON'T SHUT DOWN AMERICA'S ABILITY TO PURCHASE FIREARMS
BY DUNCAN JOHNSON

U.S.A. -(Ammoland.com)- As COVID-19 continues to spread and
Americans continue to purchase firearms for self-defense, the FBI
will need to maintain the National Instant Check System (NICS).
Current wait times are already higher than ever before as
unprecedented numbers of purchases have flooded the system.
With no clear end in sight, Gun Owners of America has sent a letter
to the FBI, urging them to maintain the system so Americans can
exercise their 2nd Amendment right and defend themselves and
their loved ones. From GOA:

Gun Owners of America sent a letter to the Federal Bureau of Investigation (FBI) urging the agency to avoid breakdowns in the National Instant Check System (NICS).
“Currently, the COVID-19 pandemic is revealing and exacerbating the underlying constitutional infringements with the NICS system. If state or federal governments do not remain open, then Americans will be denied their Second Amendment-protected right to purchase firearms,” GOA’s Senior Vice President Erich Pratt wrote. “The long-term solution is for Congress to repeal this law. But in the short-term, the federal government is faced with a choice: ignore the Brady Transfer Date, thus intimidating gun stores into denying Americans their rights, or reallocate resources so that Americans will not be denied their rightfully purchased firearms.”
The letter also requests that the Justice Department revoke the Bureau of Alcohol, Tobacco, Firearms and Explosives’ (ATF) letters that were sent to Alabama, Minnesota and Michigan, which exempted concealed carry permit holders from NICS.
“Gun Owners of America has always believed that the NICS federal background check system is unconstitutional because it infringes the Second Amendment rights of Americans… In times of uncertainty, the right to keep and bear arms is more important than ever. The Second Amendment cannot simply be put on hold because of COVID-19, any more than can the First or Fourth Amendments. Accordingly, we would urge [the FBI] to take the appropriate steps to ensure that Americans can acquire firearms during this time of need,” Pratt concluded.
The letter can be viewed here:

BUTTER, NOT GUNS: GESTAPO POLICE STATE NEW JERSEY SUSPENDS SECOND AMENDMENT; GETS SUED

GESTAPO POLICE STATE NEW JERSEY SUSPENDS SECOND AMENDMENT; GETS SUED

Firearm ownership may be guaranteed under our Constitution by the Second Amendment. But it’s secondary at best to the New Jersey officials who’ve closed down gun stores during our Wuhan flu panic, calling them non-essential. Now two Garden State officials — who some would say are non-essential themselves — are being sued for trampling constitutional rights.

“The case was filed by the Second Amendment Foundation and the New Jersey Second Amendment Society on behalf of Robert Kashinsky and Legend Firearms, a gun shop in the state,” reports WND.com. “Defendants are Gov. Philip D. Murphy and State Police Supt. Patrick J. Callahan.”
“‘Gov. Murphy cannot simply suspend the Second Amendment, and neither can Supt. Callahan,’ said SAF founder Alan M. Gottlieb,” WND continues. “Yet, under this emergency order, that’s exactly what they’re doing. The Constitution, and federal law, don’t allow that. New Jersey may have been the first state to ratify the Bill of Rights, but they’re the last state to recognize it.”
WND further explains:
The case developed when Kashinsky sought to purchase a firearm for personal protection during the current crisis.
However, Murphy issued Executive Order 107 on March 21 that ordered all non-essential retail businesses closed to the public. The order does not include licensed firearms dealers on its list of “essential” businesses that may continue operating during the crisis.
That means the Second Amendment was violated, the case explains.
“In order for New Jersey residents to purchase firearms,” explained Gottlieb, “they must go through a licensed firearms retailer and pass a background check. However, Murphy’s order was subsequently followed by a notice posted on the state police website that the agency is no longer conducting background checks.”
The plaintiffs also explained that while they don’t seek to minimize the Wuhan flu’s seriousness and understand that lifestyle changes are currently necessary, there are constitutional limits to the actions government may take.
For example, could a state suspend the right to free speech if it somehow considered doing so beneficial in combating the virus?
Of course, firearms aren’t technically a “survival need” like water, food, and shelter — but they can be necessary for survival. In fact, when seeing all the liberals hoarding food, one should wonder: If they really think things could get that bad, do they have guns and ammo? For a mountain of food won’t help in a social breakdown situation if bad actors can take it, and maybe your life, from you.
(And what’s with the toilet paper hoarding? So when the apocalypse comes, you can drop dead with a clean backside?)
But New Jersey, where only the mobsters are supposed to have guns, isn’t alone. While demand for firearms and ammo has recently skyrocketed as common people exercise common sense, left-wing governments are again demonstrating how uncommon the quality is. As American Thinker reports:
In mid-March, Mayor Deborah Frank Feinen, of Champaign Illinois, signed an executive order declaring a state of emergency, despite the absence of any coronavirus cases in Champaign. With the order is in place, Feinen has arrogated to herself the ability to ban gun sales.
Just a few days later, on March 16, New Orleans Mayor LaToya Cantrell also issued an emergency order allowing her to ban the sale or transportation of firearms.
In Philadelphia, the police department stopped issuing concealed carry permits, while simultaneously announcing that they would be “delaying arrests for ... narcotics offenses, thefts, burglary, and prostitution.” However, the police will “continue to arrest people carrying a firearm without a permit.” [So when three unaccountable muggers with knives rob you, you’ll be unable to defend yourself.]
In the San Francisco Bay Area, a region notoriously hostile to the Second Amendment, a gun store located in Alameda County (home to the City of Berkeley) tried to keep its two locations open despite the local and state-wide shut-down orders [video below].
WOW! California shuts gun stores as ‘non essential’ due to #coronavirus while letting criminals out AND reducing law enforcement?? @NRA @Solartactical pic.twitter.com/A7d3us4DXQ
The sheriff’s department responded to the gun dealer, as the tweet below relates.
@Solartactical you are not an essential business in Castro Valley. Please move to minimum basic operations per the Alameda County Health Order. pic.twitter.com/SWNgerwyQA
Not surprisingly, though, Solar Tactical ultimately yielded to government pressure.
Regardless of the New Jersey case’s merit and resolution, what the above reflects is that there really are “two Americas” (at least), having two radically different worldviews. People applying common sense understand that when seconds count, the police are minutes away (it has become a cliché, I know). Realize also that the Supreme Court ruled in 2005 that law enforcement has no duty to protect you.
So you’re left to protect yourself. Yet the leftists would prevent that, instituting irrational policies that could only be driven by ill intent and/or stupidity born of intellect-clouding emotion. Miscreants bent on evil, who’ll take advantage of social breakdown and commit robbery, murder, or rape, don’t care about anti-firearms prohibitions. Such laws only affect the good people.
The leftist mentality, in its least-malevolent form and often exhibited by useful idiots ignorant of the aforementioned 2005 ruling, says “It’s the government’s job to defend us.” (Heck, Bernie Sanders inveighs even against charity, claiming that it’s the government’s job, too.) History tells a different tale.
During the Los Angeles riots in 1992, a politically correct government’s sins of omission allowed for a period of mayhem, and good citizens were harmed. Innocent truck driver Reginald Denny was beaten almost to death. And the only people able to defend themselves were the armed. Just consider ex-merchant David Joo, who described in the video below what transpired outside his store in ’92 after the police fled the scene.
On a lighter note, there may be a way for gun dealers to get around future non-essential-business-closure orders. Get your establishment classified as a grocery, and sell guns “on the side” (wink, nod). Just carry a few non-perishable food items and offer them gratis with a gun purchase. You could call your store, oh, I don’t know, Guns & Butter.
As for those who know butter, and better, they understand that government is there to protect you — until it’s not.

DEMOCRATS USING CHINESE VIRUS AGAINST TRUMP, PEDDLING FALSE PREDICTIONS

DEMOCRATS USING CHINESE VIRUS AGAINST TRUMP, PEDDLING FALSE PREDICTIONS
BY R. CORT KIRKWOOD
republished below in full unedited for informational, educational and research

Government officials from the president down to mayors aren’t taking what could be counterproductive measures against the Chinese Virus simply because top virologists and epidemiologists are providing sound data that portend a future depicted in Cormac McCarthy’s The Road.
Americans aren’t locked in their homes, washing their hands, and wondering whether they’ll die of pneumonia because all the information they receive from the leftist news sources and social media are accurate.
Rather, hard-left and Democrat activists are pumping out advertisements and faulty “science” to help Democrat president contender Joe Biden and drive public officials to adopt left-wing public policies.
The goals: destroy Trump, elect Biden, and move the country toward totalitarian socialism.
Soros Again Unsurprisingly, one dark hand behind the panic is Geoge Soros, who collaborated with the Nazis during World War II. Another is leftist billionaire Donald Sussman, the founder of something called New China Capital Management, a major investment outfit.
“The Democratic Party’s leading super PAC will begin hitting President Donald Trump over coronavirus in four battleground states, using millions from liberal billionaire George Soros,” the Washington Free Beacon’s Joel Schoffstall reported yesterday:
Priorities USA Action — the Democratic Party’s largest super PAC — will spend $6 million this week on advertisements criticizing Trump for his response to the coronavirus pandemic. The ads will run in Florida, Michigan, Pennsylvania, and Wisconsin. The PAC received $3 million in contributions from Soros’s Democracy PAC on Feb. 21, new filings show. Soros’s seven-figure donation accounts for 77 percent of the $3.9 million the PAC reported hauling in last month.
The PAC will spend $150 million against Trump in key states, Schoffstall reported, and has raised “$27 million since January 2019. Its largest donor has been billionaire hedge fund manager Donald Sussman, who has given the group $8 million this cycle. Soros is now the group’s second-largest donor at $5 million.”
In its report on the pair of hate-Trump subversives citing the Wall Street Journal, the Media Research Center noted that Sussman gave $21 million to Hillary Clinton’s campaign for president, while Soros donated $9.5 million. The former Nazi stooge was Clinton’s second biggest contributor.
Scare Site Beyond the leftist hit job on Trump, a state representative from Alaska, two “tech bros,” as The Federalist’s Madeline Osburn called them, and a gaggle of other top tech titans are providing faulty data at their COVID Act Now mapping tool that supposedly tracks the pathogen’s progress.
Their information “provides users a catastrophic forecast for each state, should they wait to implement COVID Act Now’s suggested strict measures to ‘flatten the curve,’” Osburn reported, and governors and other public officials are acting on it.
“But a closer look at how many of COVID Act Now’s predictions have already fallen short, and how they became a ubiquitous resource across the country overnight, suggests something more sinister,” Osburn reported:
When Dallas County Judge Clay Jenkins announced a shelter-in-place order on Dallas County Sunday, he displayed COVID Act Now graphs with predictive outcomes after three months if certain drastic measures are taken. The NBC Dallas affiliate also embedded the COVID Act Now models in their story on the mandate.
The headline of an NBC Oregon affiliate featured COVID Act Now data, and a headline blaring, “Coronavirus model sees Oregon hospitals overwhelmed by mid-April.” Both The Oregonian and The East Oregonian also published stories featuring the widely shared data predicting a “point of no return.”
Michigan Gov. Gretchen Whitmer cited COVID Act Now when telling her state they would exceed 7 million cases in Michigan, with 1 million hospitalized and 460,000 deaths if the state did nothing.
The models predict, ominously, a “point of no return,” a great concern because “COVID Act Now’s predictions have already been proven to be wildly wrong.”
COVID Act Now predicted that by March 19 the state of Tennessee could expect 190 hospitalizations of patients with confirmed Wuhan virus. By March 19, they only had 15 patients hospitalized.
In New York, COVID Act Now claimed nearly 5,400 New Yorkers would’ve been hospitalized by March 19. The actual number of hospitalizations is around 750. The site also claimed nearly 13,000 New York hospitalizations by March 23. The actual number was around 2,500.
In Georgia, COVID Act Now predicted 688 hospitalizations by March 23. By that date, they had around 800 confirmed cases in the whole state, and fewer than 300 hospitalized.
In Florida, COVID Act Now predicted that by March 19, the state would face 400 hospitalizations. On March 19, Gov. Ron DeSantis said 90 people in Florida had been hospitalized.
It’s no surprise that COVID Act Now’s data are shockingly inaccurate. The people who run the data site are not scientists — meaning virologists or epidemiologists, Osburn reported.
The founders are Jonathan Kreiss-Tomkins, a Democrat in Alaska’s legislature, and three Democrat tech executives: “Zachary Rosen, Max Henderson, and Igor Kofman — who are all also donors to various Democratic campaigns and political organizations since 2016. Henderson and Kofman donated to the Hillary Clinton campaign in 2016, while Rosen donated to the Democratic National Committee, recently resigned Democratic Rep. Katie Hill, and other Democratic candidates.”
Public officials have acted on the faulty progression models.
Last week, a top epidemiologist warned that lockdowns and other measures based on faulty data could be counterproductive.
