“Palestinian President Mahmoud Abbas, Jordan’s King Abdullah and Egyptian President Abdel Fattah al-Sisi, who all received phone calls from Trump on Tuesday, joined a mounting chorus of voices saying any unilateral U.S. move on Jerusalem could unleash turmoil.”
The U.S. has been kowtowing to this threat for decades. It’s time we stop. Showing that we will not be intimidated by jihad threats is much more likely to make us stronger in the long run than reinforcing the impression that we can be manipulated by promises of violence. The “Palestinians” and their allies are already waging jihad against Israel. This will not change that; it will only become the latest of many pretexts. If it weren’t this that jihadis were outraged over, it would be something else. It is high time we told them that we are going to do what is right, come what may.

“Trump tells Mideast leaders of plan to move embassy to Jerusalem in break with U.S. policy,” by Steve Holland and Nidal al-Mughrabi, Reuters, December 5, 2017:
WASHINGTON/GAZA — President Donald Trump told Arab leaders on Tuesday that he intends to move the U.S. embassy in Israel to Jerusalem, a move that would break with decades of U.S. policy and risks fueling further unrest in the Middle East.
Senior U.S. officials have said Trump is likely on Wednesday to recognize Jerusalem as Israel’s capital while delaying relocating the embassy from Tel Aviv for another six months, though he is expected to order his aides to begin planning such a move immediately.
The officials said, however, that no final decisions have been made. U.S. endorsement of Israel’s claim to all of Jerusalem as its capital would reverse long-standing U.S. policy that the city’s status must be decided in negotiations with the Palestinians, who want East Jerusalem as the capital of their future state. The international community does not recognize Israeli sovereignty over the entire city, home to sites holy to the Muslim, Jewish and Christian religions.
Palestinian President Mahmoud Abbas, Jordan’s King Abdullah and Egyptian President Abdel Fattah al-Sisi, who all received phone calls from Trump on Tuesday, joined a mounting chorus of voices saying any unilateral U.S. move on Jerusalem could unleash turmoil.
Trump notified Abbas “of his intention to move the American Embassy from Tel Aviv to Jerusalem,” Abbas spokesman Nabil Abu Rdainah said. Abbas, in response, “warned of the dangerous consequences such a decision would have to the peace process and to the peace, security and stability of the region and of the world” and also appealed to the pope and the leaders of Russia, France and Jordan to intervene.
The Jordanian monarch told Trump that moving the embassy would have “dangerous repercussions” for the region and would obstruct U.S. efforts to promote Israeli-Palestinian peace talks, according to a palace statement. Egypt’s Sisi cautioned Trump against “taking measures that would undermine the chances of peace” and complicate matters in the Middle East, a presidential statement released in Cairo said.
None of the leaders’ statements said whether Trump, who was also due to talk to Israeli Prime Minister Benjamin Netanyahu, specified the timing of an embassy move.
But U.S. officials, speaking on condition of anonymity, said Trump would sign a national security waiver – as have his predecessors – keeping the embassy in Tel Aviv for another six months but would commit to expediting a move. It was unclear, however, whether he would set a date.
Trump, who promised during the 2016 presidential campaign to move the embassy to Jerusalem and is expected to announce his decision in a speech on Wednesday, appears intent on satisfying the pro-Israel, right-wing base that helped him win the presidency. Israeli Intelligence Minister Israel Katz, who met last week with U.S. officials in Washington, told Israel’s Army Radio: ”My impression is that the president will recognize Jerusalem, the eternal capital of the Jewish people for 3,000 years, as the capital of the state of Israel.”
Asked if Israel was preparing for a wave of violence if Trump recognizes Jerusalem as the Israeli capital, he said: ”We are preparing for every option. Anything like that can always erupt. If Abu Mazen (Palestinian President Mahmoud Abbas) will lead it in that direction then he will be making a big mistake.”
Turkey threatened on Tuesday to cut diplomatic ties with Israel if Trump recognizes Jerusalem. “Mr. Trump, Jerusalem is the red line of Muslims,” Turkey’s President Tayyip Erdogan told a parliamentary meeting of his ruling AK Party.

Senior U.S. officials told Reuters some officers in the State Department were also deeply concerned and the European Union, the Palestinian Authority, Saudi Arabia and the Arab League all warned that any such declaration would have repercussions across the region.
FEARS OF BACKLASH
Netanyahu has so far declined to speculate on what Trump might say. But Katz took to Twitter to reject Turkey’s threat and reiterate Israel’s position on the city, which is one of a long list of stumbling blocks in years of failed peace talks with the Palestinians. “We don’t take orders or accept threats from the president of Turkey,” he wrote.
Two U.S. officials said on condition of anonymity that news of the plan to recognize Jerusalem as Israel’s capital had kicked up resistance from the State Department’s Near Eastern Affairs bureau, which deals with the region.
“Senior (officials) in NEA and a number of ambassadors from the region expressed their deep concern about doing this,” said one official, saying the concerns focused on “security.”
The State Department referred questions to the White House. The White House did not immediately respond to requests for comment. A fourth U.S. official said the consensus U.S. intelligence estimate on U.S. recognition of Jerusalem as Israel’s capital was that it would risk triggering a backlash against Israel, and also potentially against U.S. interests in the Middle East.
It could also derail a fledgling Israeli-Palestinian peace effort led by Trump’s son-in-law and senior adviser, Jared Kushner.
The European Union’s top diplomat, Federica Mogherini, said on Tuesday that “any action that would undermine” peace efforts to create two separate states for the Israelis and the Palestinians “must absolutely be avoided.”…

Saudi King: Moving embassy to Jerusalem
“a flagrant provocation of Muslims,

And “Palestinian” top dog Mahmoud Abbas “warned of the dangerous consequences such a decision would have to the peace process and to the peace, security and stability of the region and of the world.”
They’re saying, “Don’t do this, or Muslims will kill people.” It’s just the kind of violent intimidation that neither Trump nor any free person should give in to, for doing so will only encourage more of it.

“Trump’s Jerusalem calls spark warnings from Arab leaders,” BBC, December 5, 2017:
Arab leaders have warned US President Donald Trump that moving the American embassy in Israel to Jerusalem could have dangerous repercussions.
Mr Trump phoned several regional leaders on Tuesday to tell them he intended to move it from Tel Aviv.
Saudi Arabia’s King Salman told the US leader that any such move would provoke Muslims around the world.
The calls came amid speculation that Mr Trump could recognise Jerusalem as Israel’s capital on Wednesday.
He is scheduled to deliver remarks and White House spokeswoman Sarah Sanders said he was “pretty solid” in his thinking on the issue.
The city’s fate is one of the thorniest issues between Israel and the Palestinians.
If Washington recognises Jerusalem as Israel’s capital, it would be the first country to do so since the foundation of the state in 1948.
King Salman told Mr Trump that the relocation of the embassy or recognition of Jerusalem as Israel’s capital “would constitute a flagrant provocation of Muslims, all over the world”, the official Saudi Press Agency reported.
Meanwhile, US government employees and their families have been barred from personal travel in Jerusalem’s Old City and the West Bank for security reasons ahead of planned protests.
In other reaction from leaders who spoke to Mr Trump:
Palestinian leader Mahmoud Abbas “warned of the dangerous consequences such a decision would have to the peace process and to the peace, security and stability of the region and of the world”
Jordan’s King Abdullah said the decision would “undermine efforts to resume the peace process” and provoke Muslims. Jordan acts as custodian of the Islamic sites in Jerusalem
Egypt’s President Abdul Fattah al-Sisi urged Mr Trump “not to complicate the situation in the region”…

JUDGE: MILITARY MUST START ADMITTING TRANSGENDERS BY JANUARY 1, 2018

JUDGE: MILITARY MUST START ADMITTING TRANSGENDERS BY JANUARY 1, 2018
BY DAVE BOHON

republished below in full unedited for informational, educational, and research purposes:

A federal judge has ruled on Monday that the U.S. military must begin to admit transgenders — those who identify with and behave according to the opposite sex — into its ranks by January 1, overturning President Trump's announcement in July that such individuals would be banned from serving.
U.S. District Judge Judge Colleen Kollar-Kotelly, who in October partially blocked the president's ban while a lawsuit filed by transgender soldiers proceeds in court, ruled that her injunction means the Defense Department must follow through on the order given by President Obama June 30, 2016 allowing transgender individuals to enlist beginning January 1.
Defense Secretary Jim Mattis was set to begin processing transgenders into the service branches before President Trump's July 26 Twitter announcement that “the United States government will not accept or allow transgender individuals to serve in any capacity in the U.S. military. Our military must be focused on decisive and overwhelming victory and cannot be burdened with the tremendous medical costs and disruption that transgender in the military would entail.”
Referring to one of at least four transgender lawsuits against the Trump ban, Kotelly ruled that “Secretary Mattis is a defendant in this case, he is directly bound by the injunction, and he cannot change the policy that existed before President Trump issued his order.”
While the Trump administration is appealing the order, there was no indication that it would seek to block the January 1 recruiting deadline. In a statement Justice Department spokeswoman Lauren Ehrsam simply said: “We disagree with the Court's ruling and are currently evaluating the next steps.”
The Department of Justice has contended that the lawsuit for which Kotelly wrote the preliminary injunction is premature since the Defense Department has not yet finalized its own plan on transgender troops. The president had given the Pentagon until March to eliminate costly gender reassignment surgeries and to determine how to deal with transgender individuals who are currently serving in the military.
In late November President Trump's ban was dealt second legal blow when U.S. District Judge Marvin Garbis in Baltimore ruled that the ban “cannot possibly constitute a legitimate governmental interest,” saying that it was not backed by any real concern over military need. “The lack of any justification for the abrupt policy change,” wrote Garbis, “combined with the discriminatory impact to a group of our military service members who have served our country capably and honorably, cannot possibly constitute a legitimate governmental interest.”
The ACLU, which is representing some of the transgender plaintiffs in the lawsuit against the ban, applauded the latest legal maneuvers. “We're pleased that the courts have stepped in to ensure that trans service members are treated with the dignity and respect they deserve,” said ACLU attorney Joshua Block in a statement.
By contrast, Tony Perkins of the Family Research Council, which has been a clarion voice for common-sense military policy, responded to Kotelly's ruling by noting that “this is where judicial activism is leading us. The courts have moved beyond legislating on the invented rights of abortion and same-sex marriage to clearly usurping the constitutional authority of the executive branch.”
Perkins noted that President Trump “has the primary task of protecting Americans, but we see the courts weakening his immigration policies designed to protect America from threats and now telling the commander-in-chief how to run the military.”

EXCERPTS:
WASHINGTON — A federal judge appointed to the bench by then-President Bill Clinton has issued an order clarifying her recent injunction against the Trump administration’s ban on “transgender” enlistment in the U.S. Armed Forces, and has outlined that the government must allow the enlistment beginning Jan. 1.
“[The previous] order was to revert to the status quo with regard to accession and retention that existed before the issuance of the presidential memorandum—that is, the retention and accession policies established in the June 30, 2016 directive-type memorandum as modified by Secretary of Defense James Mattis on June 30, 2017,” wrote U.S. District Judge Colleen Kollar-Kotelly.
“Those policies allowed for the accession of transgender individuals into the military beginning on January 1, 2018,” she continued. “Any action by any of the defendants that changes this status quo is preliminarily enjoined.”

TRUMP ADMINISTRATION ORDERS WITHDRAWAL FROM U.N. MIGRANT ACCOMMODATING AGREEMENT

TRUMP ADMINISTRATION ORDERS WITHDRAWAL FROM U.N. MIGRANT ACCOMMODATING AGREEMENT

republished below in full unedited for informational, educational, and research purposes:

On Saturday, December 2, the Donald Trump administration alerted the office of the United Nations secretary-general that the United States of America is withdrawing from a UN agreement aimed at handling migrant and refugee issues.
"Today, the U.S. Mission to the United Nations informed the UN Secretary-General that the United States is ending its participation in the Global Compact on Migration," the U.S. mission to the United Nations announced in a press release.
In September 2016, the UN General Assembly unanimously agreed on a resolution — the New York Declaration for Refugees and Migrants — that the organization’s member states would be committed to the document, which “reaffirms the importance of the international refugee regime and represents a commitment by Member States to strengthen and enhance mechanisms to protect people on the move,” as described in a UN statement on the goals of the policy.
The UN statement further explains:
In adopting the New York Declaration, Member States:
• expressed profound solidarity with those who are forced to flee;
• reaffirmed their obligations to fully respect the human rights of refugees and migrants;
• agreed that protecting refugees and the countries that shelter them are shared international responsibilities and must be borne more equitably and predictably;
• pledged robust support to those countries affected by large movements of refugees and migrants;
• agreed upon the core elements of a Comprehensive Refugee Response Framework; and
• agreed to work towards the adoption of a global compact on refugees and a global compact for safe, orderly and regular migration.
The Declaration contains a call to the United Nations High Commissioner for Refugees to propose a “global compact on refugees” by 2018.
None of this apparently sits well with President Trump.
"The New York Declaration contains numerous provisions that are inconsistent with U.S. immigration and refugee policies and the Trump Administration's immigration principles. As a result, President Trump determined that the United States would end its participation in the Compact process that aims to reach international consensus at the UN in 2018," the U.S. statement said.
U.S. Ambassador to the United Nations Nikki Haley said that "America is proud of our immigrant heritage and our long-standing moral leadership in providing support to migrant and refugee populations across the globe," and that "our generosity will continue." She added: "But our decisions on immigration policies must always be made by Americans and Americans alone. We will decide how best to control our borders and who will be allowed to enter our country. The global approach in the New York Declaration is simply not compatible with U.S. sovereignty.”
And that is the core issue.
Sovereignty surrendered to the United Nations or to any other governing body whether it be through resolutions or trade agreements, is not compatible with the U.S. Constitution which in Article 4, Section 4 guarantees to each state a “republican form of government.”
A republic, as defined by James Madison in Federalist Number 10 is a form of government “in which the scheme of representation takes place.”
No citizen of the United States votes for any representative of the United Nations, not even the one ostensibly representing the interests of the United States at the world body itself.
Furthermore, there is but one just basis upon which government is founded and that is consent of the governed. Americans have no way to consent to the resolutions debated and adopted by the United Nations, particularly not one which would force sanctions upon this country for “racism and xenophobia,” two misdeeds named in the New York Declaration, but conveniently not defined.
Had the Trump administration not wisely withdrawn from this agreement, the government of the United States would have been obliged to provide for the “protection, health, [and] education” of migrants and refugees.
It’s not just the federal government that would be put upon by the General Assembly to facilitate the accommodation of migrants and refugees, but other institutions and organizations would be likewise bound to “ease the burdens” of those seeking asylum or a better life in the United States.
The Declaration requires the cooperation of “government at national and local levels, international and regional financial institutions, UN Agencies and NGO partners, and business and civil society actors” in the migrant support scheme.
Fortunately, for now it appears that the United States — their government and private banks and businesses — will be free of the fetters placed on their sovereignty by the New York Declaration for Refugees and Migrants.

BARBIE INSTAGRAM ACCOUNT SHOWS DOLL WEARING HOMOSEXUAL ADVOCACY

MALIBU, Calif. — The designers of the famed fashion doll Barbie recently released two photos on Instagram of the figure wearing a “Love wins” t-shirt as a way to show support for homosexual causes.
“Proud to wear this ‘Love Wins’ shirt with @songofstyle!” the Nov. 21 Barbiestyle post read in part, referring to designer Aimee Song of TwoSongs Los Angeles. A doll created in Song’s likeness accompanies Barbie in both photographs.
“Such an inspiring initiative and fabulous few days I have spent with Aimee; she’s a doll!” the post exclaims.
According to Racked, the Barbiestyle Instagram account is run by Vice President of Barbie Design at Mattel, Kim Culmone, along with Director of Design Robert Best and photographer Zlatan Zukanovic.

Song’s tee and sweatshirt company, which she operates with her sister, Dani, sells tops with messages such as “grlpwr,” “self love” and a vulgarly titled t-shirt that features an “embroidered naked woman.” Proceeds support breast cancer research.
“I’m beyond thrilled to have my own @Barbie doll and to wear my #LoveWins t-shirt from @ShopTwoSongs. I still can’t believe I got to partner with #Barbie as a brand that also celebrates diversity, kindness and acceptance,” Song wrote on Thursday, posting a photo of herself holding the doll, the two wearing matching tees.
“Beyond thrilled to be supporting the LGBTQ community with @BarbieStyle in our sold out #LOVEWINS tee,” the TwoSongs Instagram page also reads.

50% of proceeds from the shirts are donated to the homosexual advocacy effort The Trevor Project.
The photographs generated various reaction from the public, with some applauding the idea of Barbie joining in on homosexual advocacy, and others vowing to stay away from Barbie products after seeing the posts.
“This is really sweet and a good way to show kids that anyone can love anyone,” one follower wrote.
“Who needs Ken?” another remarked.
“Wow. This is so sad,” a third stated.
“Thank God I have no children yet, but when I do they’ll never play with Barbie,” another shared. “This is an abomination and not normal. Disgusting.”
Earlier this month, the makers of Barbie also announced that the company had released a doll in the likeness of Rio 2016 bronze medalist Ibtihaj Muhammad, complete with a Muslim hijab.
“We are so excited to honor @IbtihajMuhammad with a one-of-a-kind #Barbie doll! Ibtihaj continues to inspire women and girls everywhere to break boundaries. #Shero #YouCanBeAnything #GlamourWOTY,” it wrote on Nov. 13, sharing a photo of Muhammad holding the doll.
The decision was likewise met with controversy as some stated that they found it disturbing that Barbie had been dressed as a Muslim.

In a Thanksgiving tweet, The Ethics and Religious Liberty Commission (ERLC) of the Southern Baptist Convention declared what everyone already knew—that it is the bank for George Soros on immigration. The Thanksgiving Day tweet from the ERLC promoted a video from a group connected with the National Immigration Forum. The National Immigration Forum is a well-known Soros-funded open borders group [Editor’s Note: This was originally posted by the Capstone Report, link included below].
Here is the tweet.

The website of the group promoting the video is Christiandreamers.US. The “About” information on the site declares, “Voices of Christian Dreamers is a grassroots, Dreamers-led movement committed to changing the conversation about undocumented immigrants in the Church and beyond, through highlighting biblical teaching, personal stories and other helpful resources.”
It isn’t grassroots. The website WHOIS information shows the site was registered by the National Immigration Forum. The National Immigration Forum is backed by globalists including George Soros and Jeb Bush.
Here is the whois information.

At least 10 percent of the NIF’s funding comes from Soros, according to the organization. The Christian Post reported, “The Soros money, which has ‘plummeted’ in the last few years, is only about 10 percent of NIF’s budget and is only used for internal operations.”
Sure. Whatever the use, Soros is funding an organization trying to change the minds of folks sitting in the pews of conservative, evangelical churches.
According to the Center for Immigration Studies, “NIF receives millions of dollars from Soros groups, including support for its infiltration campaigns directed at evangelicals, police, and business.”
Infiltration is exactly what Soros and his fellow leftists are doing to evangelical Christian institutions. It is clear the Soros-funded campaign to muddle evangelical convictions on immigration is working. Now the ERLC tweets out open borders commercials from Soros’ think tank globalists.
Southern Baptists, your ERLC tweeted out political propaganda. Are you comfortable with that? Do you want your tithes and offerings intended to further missions work used to lobby against your political beliefs and interests? The ERLC is funded by the Cooperative Program and a portion of your undesignated tithes and offerings help fund Southern Baptist entities including the ERLC.
Are you comfortable with the elitist communitarians running things in the Southern Baptist Convention?

NEW WILLOW CREEK PASTOR JOINS THE POPE, PITS GRACE AGAINST REPENTANCE

NEW WILLOW CREEK PASTOR JOINS THE POPE, PITS GRACE AGAINST REPENTANCE
republished below in full unedited for informational, educational, and research purposes:

Willow Creek was Saddleback Church before Saddleback. For more than 30 years, Willow Creek Community Church in the Chicago area has been the flagship of the Church Growth Movement. By watering down doctrine and adopting (in some ways, inventing) the “seeker-sensitive” approach to ministry, Willow Creek herded goats into their doors, fed them sugar blocks, and slapped the word “church” on it. In 2015, the church announced that after a year of research into its membership, it recognized that their seeker-friendly approach was a near-total failure at creating serious disciples and pledged to change their ways and focus more on teaching the Bible (novel approach, we know). Since then, Willow Creek has changed leadership and seems to be struggling to change from their doctrineless, watered-down, evanjellyfish ways. Its new upcoming lead pastor, Steve Carter, recently joined the Bishop of Rome for warm fellowship and ostensible partnership.

According to this Protestant (lol) evangelical pastor, the Bishop of Rome (aka the Holy Father, Vicar of Christ and Head of the Church – three names reserved for God the Father, the Holy Spirit, and Jesus Christ) is the type of listener, pastor and encourager that he wants to be.
Gross.
Maybe Willow Creek’s new pastor hasn’t heard of the Protestant Reformation. Maybe he didn’t know that the Pope is the type and shadow of the antichrist who has raised himself up to be God. Maybe he hasn’t heard about things like the Council of Trent or Vatican I or Vatican II. Maybe he’s unaware of the Pope’s doctrines of papal infallibility, the immaculate conception and bodily assumption of Mary, purgatory, or denying Sola Fide. Maybe Steve Carter doesn’t know what he’s supposed to be doing or teaching. Maybe he’s just vaguely unfamiliar with Christian doctrine in general. It’s either that, or Carter himself is a wolf in sheep’s clothing who’s as wicked as the Pope himself.
Some social media followers questioned Carter about becoming an odd bed fellow with the Scarlet Harlot. His response in unsurprising, yet nauseating.

Firstly, writing as a Protestant here, heck yes the photo triggers us. Are you new to Protestantism, Steve. Why wouldn’t it trigger us, especially when it is laced with a compliment?
Secondly, what’s the thought here, Steve? Do you think you’re going to spend some time making selfies with the Antichrist and then become his text-buddy? Are you two going to exchange pen-pal letters now and you hope to sneak a rebuke for idolatry in there somewhere? Will there be tin cans with string tied betwixt them strung up somewhere between Chicago and Vatican City so that you and the Pope can have some long, heart-felt late-night talks? Is the presumption that the Pope just hasn’t heard of Christianity yet, and by his relationship with Steve he’ll come to Jesus? I mean, he’s the Pope. He’s heard of the Gospel. It’s anathematized in his church councils and he stands against all that is good and pure.
If you only had a few seconds with the Pope, what would you say? Here’s how Ian Paisley handled that opportunity.
IAN PAISLEY HECKLES THE POPE 1988:

Thirdly and most importantly, Steve Carter equates “grace” with “not telling someone they’re in sin.” This is a perverse understanding of grace for a pastor. As John Newton wrote, “Twas grace that taught my heart to fear…” To call someone to repentance is an act of God’s grace toward that individual. To meet with the Pope and not frantically tell him that he is Satan’s gimp is not gracious, it is treason against God and hatred toward whatever fleshly body currently sits in the Antichrist’s seat. Grace calls to repentance; not calling to repentance is hate.
One can expect the tenure of Steve Carter at Willow Creek to be graceless, because its pastor has tragically confused niceness with grace.

DR. DUKE PESTA: CAMPUS GENDER POLITICS HITS NEW LOW
Dr. Duke takes on the latest campus insanity, this time at prestigious Brown University. The graduate college has decided to allow candidates to identify with the race of their choice, ostensibly to expand campus diversity. What better way to become the most diverse campus in the world than to let everybody decide what they believe they are at that moment, regardless of reality? Given this reasoning, why not just admit one graduate student, and let him pretend to be somebody of a different race, gender, and sexuality every day? Problem solved. If you are wondering what any of this has to do with education, just pretend you’re a progressive for the day, and it will suddenly make sense.

Good. If she refuses to accept reality, leave her to her fantasies. Pretty soon the multiculti roof will cave in on her anyway, and she will realize Trump was calling attention to a real problem.

“She’s Blown It! POTUS Cancels UK Visit After PM May Grovels to EU, Whines Over Trump Tweets,” by Jack Montgomery, Breitbart, December 1, 2017:
A planned “working visit” to the United Kingdom by U.S. President Donald Trump has been cancelled following Prime Minister Theresa May’s decision to publicly upbraid him over Twitter retweets.
The prime minister said the president was “wrong” to share videos purporting to show Muslims committing acts of violence while on a visit to the Middle East, where she is attempting to curry favour with local dictators.
President Trump did not hesitate to rebuke the British politician, telling her: “Don’t focus on me, focus on the destructive Radical Islamic Terrorism that is taking place within the United Kingdom. We are doing just fine!”
News that the president has cancelled a planned “working visit” to open the new U.S. embassy in London came in the early hours of the following morning.
“The idea of a visit has obviously been floated, but not December and not January. I would not expect a Trump visit in January,” a senior U.S. diplomat told The Telegraph….

KATE STEINLE'S KILLER ACQUITTED,
SPARKING SHOCK, OUTRAGE
BY BOB ADELMANN
republished below in full unedited for informational, educational, and research purposes:

Immediately following the announcement late Wednesday that Kate Steinle’s killer, an illegal immigrant going by the name of Garcia Zarate (he had many aliases), shown, was only going to be charged with felony possession of a handgun and not first-degree murder or even manslaughter, social media lit up. Cyrus Firth twittered: “Let’s get this straight … in San Francisco, can you: - come here illegally? YES; – Unlawfully obtain a gun? YES; - Kill an innocent girl? YES; - be found “not guilty” for all? YES. THIS IS WHAT A SANCTUARY CITY LOOKS LIKE.”
Others were more temperate. President Donald Trump, who used outrage over the killing of Steinle back in July 2015 as part of his campaign for the presidency, called the verdict “disgraceful,” adding, “No wonder the people of our Country are so angry with illegal immigration.” Attorney General Jeff Sessions blamed San Francisco’s politicians for Steinle’s death:
When jurisdictions choose to return criminal aliens to the streets rather than turning them over to federal immigration authorities, they put the public’s safety at risk. San Francisco’s decision to protect criminal aliens led to the preventable and heartbreaking death of Kate Steinle.
Jim Steinle, Kate’s father who was with her when she was shot, expressed shock at the jury’s verdict: “We’re just shocked — saddened and shocked — that’s about it. There’s no other way you can coin it. Justice was rendered but it was not served.”
The narrative surrounding the charge of murder or manslaughter in the case is familiar: an illegal alien, who had been deported five times but returned to the United States a sixth time, with a record of seven felony arrests, is allowed to go free by San Francisco authorities even when they knew ICE (Immigration and Customs Enforcement) agents asked to be notified so they could pick him up for deportation. Within a few months, said illegal immigrant finds a gun, mishandles it, sending a round off the pavement and into the back of a young girl who dies within hours.
After weeks of hearing testimony the six-man, six-woman jury — three of whom were legal immigrants — deliberated for six days before reaching a verdict. They had to decide whether the shooting was intentional, or an accident. The lawyer for the alien immigrant, Matt Gonzalez said the verdict was legitimate and should be respected:
The jury’s verdict should be respected. They heard the evidence. They deliberated as a group. They heard … testimony. They looked at the physical evidence and they rendered a verdict to the best of their abilities in accordance with the law.
The challenge facing the prosecution was somewhat sizable: There was only circumstantial evidence upon which it could build a case. It had to prove that Zarate’s killing of Steinle either was both willful and premeditated, or was the unlawful killing of a human being without malice aforethought. For first-degree murder charges to stick, the prosecution had to prove to the jury “beyond a reasonable doubt” that Zarate intended to kill Steinle. The Legal Dictionary defines that term as such “that no other logical explanation can be derived from the facts except that the defendant committed the crime, thereby overcoming the presumption that a person is innocent until proven guilty.” The only way Zarate could have been convicted was for the prosecution to be so persuasive that the jurors “have no doubt as to the defendant's guilt, or if their only doubts are unreasonable doubts.” The prosecution had to prove to the jurors, at the very least, that Zarate pulled the trigger of the gun. His pulling of the trigger in a public place, resulting in death, would have led to a negligent homicide conviction. The jury evidently believed that the gun went off accidentally, without Zarate pulling the trigger. In gun-familiar Montana or some other state where gun owners would recognize how unusual an accidental misfire would be with that type of gun, a jury might have convicted. In San Francisco, not.
After six days of deliberation, they acquitted Zarate. All that is left is their ruling that he was a felon in possession of a gun, which demands a jail term of between 16 months and three years. ICE officials have said they will immediately deport Zarate for the sixth time once he has served that sentence.
Some good is likely to come out of this unhappy and painful incident. Attorney General Sessions said, “I urge the leaders of the nation’s communities to reflect on the outcome of this case and consider carefully the harm they are doing to their citizens by refusing to cooperate with federal law enforcement officers.”
It’s helpful to remember that if immigration laws had been respected and enforced, Kate Steinle would most likely still be alive, and Zarate would never have been in the country, much less mishandling that firearm on San Francisco’s Pier 4 on July 1, 2015. Kate may be deceased but her cause lives on.
