Forced vaccination? The Obama administration has issued an 88-page proposed rule giving federal officials power to detain U.S. citizens traveling within the U.S. for the purpose of examination, testing, vaccination and possible quarantine. Airports, train stations, bus terminals and U.S. ports would be compelled to cooperate in reporting Americans. Detained individuals may be required to pay for all testing, treatment, transportation and vaccination imposed by government.
 
Detention and tracking of U.S. citizens: You could be forcibly detained for 72 hours (3 days) before your case is reassessed — and longer after that—during which time you could be pressured to accept vaccination. Financial penalties for violations range from $100,000 for individuals to $500,000 for institutions.
 
No consent?: It’s not clear whether they intend to force vaccination. The language is vague, but troubling: “CDC may enter into an agreement with an individual, upon such terms as the CDC considers to be reasonably necessary, indicating that the individual consents to any of the public health measures authorized under this part, including quarantine, isolation, conditional release, medical examination, hospitalization, vaccination, and treatment; provided that the individual’s consent shall not be considered as a prerequisite to the exercise of any authority under this part.” (p. 54312)
 
Measles: Measles is mentioned 187 times in the proposed rule, but the authority would be broader: “The provisions in this NPRM describe the regulatory activities that HHS/CDC may undertake to reduce and mitigate the risk of outbreaks of Ebola, MERS, measles, and other communicable diseases in the United States.” Would detention for failure to vaccinate against chickenpox, HPV, and HIV be next?
 
Sweeping surveillance: The proposed rule would force airports, bus stations, train stations and more to collect and report data on Americans. The proposal states, “As part of the public health prevention measures, CDC may require individuals to provide contact information such as U.S. and foreign addresses, telephone numbers, email addresses, and other contact information, as well as information concerning their intended destination, health status, and travel history.”

I support consent requirements for vaccination. Thus I oppose the proposed “Control of Communicable Diseases” rule as an unconstitutional infringement of my rights. I oppose the plan torestrict travel of U.S. citizens “moving between U.S. states” who are “reasonably believed to be infected” with a host of diseases citizens may not actually have.  I oppose federal officials being empowered to “determine whether such an individual may be apprehended or examined for potential infection,” and to quarantine and issue “travel permits” to U.S. citizens that allow or prohibit their travel between states.
 
I oppose empowering federal officials to detain citizens that may or may not have or have been exposed to measles, in a violation of the individual freedoms guaranteed by the U.S. Constitution. The rule itself says measles is “not a quarantinable communicable disease.” (p. 54236)
 
I further oppose airports, train stations and other facilities, being forced to collect and report 17 data elements on American travelers to the federal government. I also oppose the proposed misdemeanor charges, financial penalties and potential use of police force for detention.
 
CCHF has fought federal “emergency health powers” initiatives since 2002 when they began after 9/11. We won vaccination refusal rights in Minnesota law.
