Obamacare Exchange Opt-Out
I declare that I am opting out of any and all participation in the national Obamacare Exchange system. I hereby
refuse to enroll in -- or use -- any state-based, “state-federal partnership,” or federal healthcare.gov website
portal (“health exchange”) created under the 2010 Patient Protection and Affordable Care Act (PPACA). I base
this declaration in part on the following reasons:
Privacy Protection: Without my consent, the Exchange will gather significant private data about my family
and I, “under penalty of perjury,” and share that data online through the ‘Federal Data Services Hub’ with
federal agencies, including the Internal Revenue Service (IRS), Dept. of Homeland Security (DHS), Dept. of
Health & Human Services (HHS), and Social Services Administration (SSA). In addition, the Exchange must
issue “individual risk scores” on all citizens using medical data—and track and report certain information on
treatment decisions without any individual’s consent. The law also authorizes the Exchange to collect
unspecified “other data” about me and other Americans in a new federal database: the “Health Insurance
Exchanges (HIX) Program.” (“Privacy Act of 1974,” Federal Register, 2/6/13, p. 8538-8542)
National Insurance Registration System: The Exchange will gather data and monitor all participants in
the Exchange, individual buyers, insurance sellers, employees and employers. (Sec. 1311) The Exchange will
use data gathered from State and Federal agencies, employers, insurers, and individuals and provide that data to
the IRS to enable enforcement of IRS penalties on non-compliant individuals and employers. The Exchange
will thus compel individuals and employers to purchase only government-approved insurance.
Coercive Attack on Free Market Medical Care: Using the bait of federal subsidies and Medicaid, the
Exchange is designed to entrap individuals in the Exchange and never let them out. (Sec. 1401) To receive
subsidies or Medicaid, the Exchange requires these individuals to enroll in the Exchange and unwittingly
provide their private data to multiple state and federal government agencies for tracking. The Exchange offers
no private insurance. Every person who submits to the Exchange must provide their most personal financial and
health information “under penalty of perjury.” (http://go.cms.gov/182nOFY)
Right to Not Participate: On June 28, 2012, the U.S. Supreme Court ruled that I cannot be required by law
to purchase any insurance or enroll in any government Exchange coverage. Furthermore, Section 1555 of the
PPACA affirms an individual’s right to choose to opt out of the Exchange:
SEC. 1555 [42 U.S.C. 18115]. FREEDOM NOT TO PARTICIPATE IN FEDERAL HEALTH
INSURANCE PROGRAMS. No individual, company, business, nonprofit entity, or health insurance issuer
offering group or individual health insurance coverage shall be required to participate in any Federal health
insurance program created under this Act (or any amendments made by this Act), or in any Federal health
insurance program expanded by this Act (or any such amendment), and there shall be no penalty or fine imposed
upon any such issuer for choosing not to participate in such programs."
The national Exchange system is not a “marketplace” to buy health insurance. It is a federal command and
control center that employs the states to abuse individual privacy and economic freedom with the false promise
of government provided “health care.”
Therefore, I am opting out of the PPACA’s intrusive government-run Exchange.
