WASHINGTON — U.S. Supreme Court Chief Justice John Roberts and newly-appointed Justice Brett Kavanaugh joined the liberal judges on the nation’s highest court on Monday to turn down appeals from two states challenging lower court rulings striking down efforts to defund Planned Parenthood’s participation in state Medicaid programs.
Justices Clarence Thomas, Samuel Alito and Neil Gorsuch were the only three of the nine judges who dissented with the decision not to hear the cases of Gee v. Planned Parenthood (out of Louisiana) and Anderson v. Planned Parenthood (out of Kansas). Four votes are needed to hear a case.
13 states had joined Louisiana and Kansas in amicus briefs, urging the Supreme Court to hear the appeals. Supportive states included Georgia, Idaho, Missouri, Michigan, Nebraska, Oklahoma, Texas, West Virginia, Wyoming, Utah and Wisconsin.
“The circuits are divided over whether Medicaid beneficiaries have a private right of action to challenge a state’s disqualification of a provider under the Medicaid Act. Five circuits have decided that the Medicaid provider-choice provision may be privately enforced under Section 1983, while one has held that it may not,” the Gee brief outlines.

It asked the court clear up the matter since “[u]ntil this split is resolved, patients in the Fifth, Sixth, Seventh, Ninth, and Tenth Circuits have the right to bring suit in federal court if their preferred provider’s agreement is terminated, while patients in the Eighth Circuit do not.”

Chief Justice Clarence Thomas wrote an explanation of his dissent from the majority, noting that the cases before the court wouldn’t have even dealt with the legality of abortion, and that he fears his colleagues rejected the appeals simply because the name Planned Parenthood was involved.
“So what explains the court’s refusal to do its job here? I suspect it has something to do with the fact that some respondents in these cases are named ‘Planned Parenthood,'” Thomas lamented. “That makes the court’s decision particularly troubling, as the question presented has nothing to do with abortion.”
“It is true that these particular cases arose after several States alleged that Planned Parenthood affiliates had, among other things, engaged in ‘the illegal sale of fetal organs’ and ‘fraudulent billing practices,’ and thus removed Planned Parenthood as a state Medicaid provider,” he continued. “But these cases are not about abortion rights. They are about private rights of action under the Medicaid Act.”
Thomas added, “Resolving the question presented here would not even affect Planned Parenthood’s ability to challenge the States’ decisions; it concerns only the rights of individual Medicaid patients to bring their own suits.”

Planned Parenthood applauded the appeal rejection, with new president Leana Wen referring to the abortion and contraceptive giant’s sexually-centered business as one of providing “health care.”
“We are pleased that lower court rulings protecting patients remain in place,” she said. “Every person has a fundamental right to health care, no matter who they are, where they live, or how much they earn. As a doctor, I have seen what’s at stake when people cannot access the care they need, and when politics gets in the way of people making their own health care choices.”

Russia sent the planes after Venezuelan President Nicolas Maduro held talks in Moscow last week with Russian President Vladimir Putin, who has expressed support for the socialist government. The United States has been fiercely critical of Maduro and what it calls his rigged elections and corrupt policies that suppress human rights and free speech. The collapse in world energy prices has also left oil-rich Venezuela's economy in tatters. Many basic foods and medicine are in severely short supply and thousands of Venezuelans flee the country every day. Maduro blames his country's problems on the United States and what he says is its support for the opposition.

According to Gina Goh, Southeast Asia regional manager for International Christian Concern, officials beat, tortured, and denied food and restroom accommodations to the Christian detainees. Some of the Christians were dragged along the ground, stepped on, bound to chairs, and had handfuls of hair pulled from their scalp, Goh said. Six days later, authorities repeated the exercise on the Rongguili Church in Guangzhou, the largest unregistered church in south China. Local officials shut down the church, interrupting a children’s Bible class, and confiscated some 4,000 religious books. The pre-Christmas raids are part of an escalating crackdown on house churches and unsanctioned Christians, as part of an effort by the Xi regime to secure absolute control over all religious activities in the country.  CHENGDU — An elder of Early Rain Covenant Church penned a handwritten letter providing spiritual exhortation and guidance on how the church should proceed in the middle of persecution as over 100 members, including pastors, elders and deacons, were detained on Sunday by Chinese police.
“Beloved brothers and sisters, do you have joy?” asked Li Yingqiang. “Are you rejoicing in the fact that you are suffering with Christ because of this church? Do you know that we are blessed?”
“The Lord is bestowing on us poor people today treasures of glory from Heaven!” he wrote. “The Lord himself is bestowing on us weak people comfort from Heaven! The Lord Jesus is shining on us blind people his great light. Those of us brothers and sisters standing on the front lines of the gospel war will earn great spiritual riches!”
 Reports state that the church was shut down because it was “unauthorized.” Members of the church posted images to the Early Rain Facebook page of bruises and torn clothing that they allegedly suffered at the hands of the Chinese police.

Time is running out for President Trump to lock down the money for what he calls his “Great Wall” on the border, news that coincides with a rise in illegal immigration apart from the migrant horde that threatens invasion from the border city of Tijuana.
If Congress doesn’t fund Trump’s No. 1 priority before this session ends, he’ll have to deal with leftist, open-borders Democrats who have said they won’t fund a wall, since this would stop the importation of more future Democratic voters. That they will not allow to happen.
So as the wall remains unbuilt, the illegal-alien invasion threat is building.
Trump Tweets: The Military Can Build It
Trump hammered the Democrats again this morning on Twitter.
“Ice, Border Patrol and our Military have done a FANTASTIC job of securing our Southern Border,” he tweeted. “A Great Wall would be, however, a far easier & less expensive solution. We have already built large new sections & fully renovated others, making them like new.
But “for strictly political reasons and because they have been pulled so far left,” the Democrats “do NOT want Border Security,” he continued. “They want Open Borders for anyone to come in. This brings large scale crime and disease. Our Southern Border is now Secure and will remain that way.”

Then The Donald warned that if Democrats won’t help him build his Great Wall, he will do it himself on this own authority by conscripting the military. “People do not yet realize how much of the Wall, including really effective renovation, has already been built,” he tweeted. “If the Democrats do not give us the votes to secure our Country, the Military will build the remaining sections of the Wall. They know how important it is!”
That move, undoubtedly, would inspire political and perhaps legal hurricane.
Trump wants $5 billion for the wall and has said he’ll let the some of the government shut down next week — once, again, Congress is at an impasse on the budget — if Congress doesn’t give him what he wants.
But he does look forward to meeting with Democrat chieftains Nancy Pelosi and Chuck Schumer. Pelosi has said the wall is merely a sign that Trump is insecure about his masculinity.
Illegal Immigration Continues
While Trump battles Congress over funding for his border wall, illegal immigration remains a growing problem, highlighting the need for better control of our southern border.
U.S. Border Patrol agents collared a whopping 51,856 people, including 25,172 “family units” and 5,283 unaccompanied minors, trying to sneak into the country in November, the second month of fiscal 2019.
In October, the number of illegals who jumped the border was 51,001, including 23,115 “family units” and 4,982 unaccompanied minors.
So thus far this year, the Border Patrol has cuffed more than 100,000 illegal aliens.
That is nearly double the number of illegals the Border Patrol caught in fiscal 2018: 25,488 in October and 29,085 in November, or 54,573.
For all of last year, border police caught 396,579, not counting the 124,511 migrants who presented themselves at ports of entry but were deemed inadmissible.
But Democrats don’t want to build a wall.
Migrant Horde Adding To Illegal-Alien Threat
The so-called migrant caravan isn’t helping matters.
Members of the 6,000-strong horde, who carry communicable diseases as Trump noted, are sneaking into the country with alarming regularity.
Migrants are digging under the border fence, as The New American reported yesterday, as well as squeezing through gaps and even hopping over when pregnant. A pregnant Honduran traveled with the caravan, she admitted, just so she could give birth on U.S. territory because the new infant would be a U.S. citizen.
Last week, reporters witnessed more than two dozen of the law-flouting illegals using ropes made of blankets to breach the fence near Tijuana.
Once in, they falsely claim asylum, knowing, undoubtedly, that U.S. officials cannot remove them before the lengthy rigmarole involved in such an application is complete. That permits them time to deliver children, or if they wish, simply disappear.
They also know that sympathetic leftists in the U.S. government will not help immigration authorities catch them.
Just last week, New Jersey’s Democratic attorney, whose parents were born in India, published an order forbidding state law-enforcement authorities from helping immigration officials collar illegal aliens.
While building an effective barrier on our southern border is certainly one solution to the problem of illegal immigration, perhaps a better solution would be to stop incentivizing the illegal immigration in the first place. Ending birthright citizenship, actually enforcing laws against hiring illegal immigrants, and refusing to offer non-citizens any form of government benefits would go a long way toward stopping the problem. If you don't make entering the country illegally worth their while, people usually won't do it.

Google CEO Sundar Pichai lied to Congress during testimony today when he claimed that users could opt out of Google’s location tracking services, a claim that the Associated Press previously found to be false.
During his appearance in front of the the House Judiciary committee for a hearing entitled: Transparency & Accountability: Examining Google and its Data Collection, Use and Filtering Practices, Pichai claimed that users had control of what information Google stored about them.
“For Google services, you have a choice of what information is collected, and we make it transparent,” Pichai said, adding, “We give clear toggles, by category, where they can decide whether that information is collected, stored, or – more importantly – if they decide to stop using it.”
However, this is categorically untrue.
As an investigation by the Associated Press back in August confirmed, Google is tracking the location of its users even when the location tracking option is turned off.
“An Associated Press investigation found that many Google services on Android devices and iPhones store your location data even if you’ve used a privacy setting that says it will prevent Google from doing so,” the news agency reported.
Even with the option to pause location history turned off, “Some Google apps automatically store time-stamped location data without asking,” states the report.
Google’s maps app stores a snapshot of your location whenever you open it, daily weather updates on Android also record your rough location and Google searches also pinpoint and store your precise latitude and longitude down to a single square foot.
Before Pichai gave his testimony, he was confronted by Alex Jones and Roger Stone.
Anti-censorship activists who accuse Google of working with the Chinese government to out political dissidents have also made their presence felt at the hearing.

More than 60 human rights groups are now taking aim at Google over its development of a censored search engine custom made for China.

The groups say that Google has downplayed concerns over Dragonfly, the search engine project designed to restrict information on human rights and other subjects forbidden by the Chinese government.
According to The Intercept:

A prototype for the censored search engine was designed to blacklist broad categories of information about human rights, democracy, and peaceful protest. It would link Chinese users’ searches to their personal cellphone number and store people’s search records inside the data centers of a Chinese company in Beijing or Shanghai, which would be accessible to China’s authoritarian Communist Party government.
If the plan proceeds, “there is a real risk that Google would directly assist the Chinese government in arresting or imprisoning people simply for expressing their views online, making the company complicit in human rights violations,” the human rights groups wrote in a letter that will be sent to Google’s leadership on Tuesday.
The letter, written by groups from all over the world, doesn’t mince words:
New details leaked to the media strongly suggest that if Google launches such a product it would facilitate repressive state censorship, surveillance, and other violations affecting nearly a billion people in China. Media reports state that Google has built a prototype that censors “blacklisted” search terms including “human rights,” “student protest” and “Nobel Prize,” including in journalistic concerns, and links users’ search queries to personal phone numbers. The app would also force users to sign in to use the service, track and store location information and search histories, and provide “unilateral access” to such data to an unnamed Chinese joint venture company, in line with China’s data localization law – allowing the government virtually unfettered access to this information.
China represents over 18% of the world population.
Also, keep in mind that numerous tech sites already demand phone numbers from users worldwide in exchange for setting up accounts under the guise of “fighting spam,” which is fueling concerns that, in the future, certain aspects of Dragonfly won’t be limited to just China.
Alex Jones, who has also raised the alarm on Project Dragonfly, is at Tuesday’s Google hearing in Washington, DC, to protest this mass censorship.
