On Friday, as the disturbances in Missouri reached a crescendo, the Department of the Army released an innocuously titled document, 
ATP 3-39.33

“The Constitution of the United States provides two exceptions for which the Posse Comitatus Act does not apply,” the ATP 3-39.33 document argues. “These exceptions are based upon the inherent right of the U.S. government to ensure the preservation of public order and to carrying out governmental operations within its territorial limits by force, if necessary.”
According to the Army the exclusions include a “sudden and unexpected civil disturbance, disaster, or calamity may seriously endanger life and property and disrupt normal governmental functions to such an extent that local authorities cannot control the situation” and the protection of federal property.

(3) When permitted under emergency authority in accordance with Reference (c), Federal military commanders have the authority, in extraordinary emergency circumstances where prior authorization by the President is impossible and duly constituted local authorities are unable to control the situation, to engage temporarily in activities that are necessary to quell large-scale, unexpected civil disturbances because:
(a) Such activities are necessary to prevent significant loss of life or wanton destruction of property and are necessary to restore governmental function and public order; or,
(b) When duly constituted Federal, State, or local authorities are unable or decline to provide adequate protection for Federal property or Federal governmental functions. Federal action, including the use of Federal military forces, is authorized when necessary to protect Federal property or functions.
On page 17 of the document, a number of different scenarios are listed under which the military is forbidden involvement, although the broader power of quelling domestic disturbances without presidential or congressional authorization is claimed.
In essence, this policy change seeks to supersede Posse Comitatus, the 1878 law which forbids the military from being involved in domestic law enforcement “except in cases and under circumstances expressly authorized by the Constitution or Act of Congress.”
Under the Insurrection Act of 1807, the President may deploy armed forces domestically under extreme circumstances but Congress has to review the action every 14 days.
Under the War Powers Resolution of 1973, the President cannot commit troops to an armed conflict for a period longer than 60 days without an authorization from Congress of the use of military force or a declaration of war.
Under no circumstances in current US law is it legal for the military to deploy itself domestically without authorization from either the President, Congress or both.
In claiming this power, the Pentagon is effectively opening the door to a potential future military coup.

Materials from Groundbreaking NBC Television Series “Will & Grace,” Renee Richard’s Tennis Racquet and the Original Transgender Pride Flag

As part of its mission to document the full breadth of the American experience, the Smithsonian’s National Museum of American History will add a significant number of objects and archival materials related to LGBT history, including Renee Richard’s tennis racquet, the original transgender pride flag, materials from the NBC television series Will & Grace and the diplomatic passports of former U.S. Ambassador to New Zealand and Samoa David Huebner and his spouse, Duane McWaine, and will acknowledge several other recent donations.
The museum will officially accept the objects into its collections at a donation ceremony today, that will be attended by Huebner and McWaine; Will & Grace creators David Kohan and Max Mutchnick; flag designer Monica Helms; Washington, D.C., photographer Patsy Lynch; Florida photographer Silvia Ros; Mark Meinke, LGBT historian and activist; and representatives from donor organizations: Gay, Lesbian, Bisexual and Transgender Community Center of Baltimore and Central Maryland and the DC Cowboys. 
“The pursuit of civil rights in America is woven throughout our history,” said John Gray, director of the museum. “It is a tale of struggle and accomplishment as the nation strives to fulfill its ideals. We are grateful to our donors for assisting us to fulfill our mission to help the public understand the past in order to make sense of the present and shape a more humane future.
DC Cowboys Dance Company Records
Founded by Kevin Platte, the DC Cowboys Dance Company was an all-male, gay, non-profit dance group based in Washington, D.C., active from 1994 to 2012. The donation includes business records and documentation of its national and international performances, along with photographs and costuming.
Gay, Lesbian, Bisexual and Transgender Community Center of Baltimore and Central Maryland
The Gay and Lesbian Community Center of Baltimore is donating material documenting LGBT life in Baltimore during the past 40 years. Included are photographs, gay pride ephemera, editor’s files from the Baltimore Gay Paper, Gay Life, correspondence, advertising and materials related to the National Association of LGBT Community Centers.
Monica Helms, Transgender Pride Flag
Helms joined the Navy after high school, serving in the engine room of two submarines until 1978. In 1997, she started living as a woman and became involved in transgender activism. She created the first transgender pride flag in 1999 as a symbol of transgender diversity and rights and debuted it at a pride parade in Phoenix in 2000. Helms is also donating a Transgender American Veterans Association button and a TransParentDay.org rubber wrist bracelet.
Ambassador David Huebner, Diplomatic Passports
Huebner served as the U.S. ambassador to New Zealand and Samoa between 2009 and January 2014. He was the first openly gay ambassador in the Obama administration and the first LGBT ambassador knowingly confirmed by the U.S. Senate. At the Senate confirmation hearing, Huebner introduced his spouse Duane McWaine and noted that the day was their 20th wedding anniversary. The museum is adding the couple’s diplomatic passports, four challenge coins designed and distributed during Huebner’s tenure and a quilt commemorating marriage equality from Samoa.
David Kohan and Max Mutchnick, Creators of Will & Grace
Will & Grace aired on NBC from Sept. 21, 1998, to May 18, 2006, and is recognized as the most successful television series featuring gay principal characters. Creators Kohan and Mutchnick are donating a number of materials, including copies of Mutchnick’s correspondence with the Human Rights Campaign, copies of the show’s scripts and an original Al Hirschfeld caricature of the principal characters. NBC has also agreed to donate a number of objects from its archives, including a pill bottle and flask, the signboard for “Grace Adler Interior Design” and Will Truman’s framed diploma from Columbia University.
Renee Richards
Richards is an American ophthalmologist, author and former professional tennis player. In 1975, after undergoing sex-reassignment surgery, she was denied entry into the 1976 U.S. Open by the United States Tennis Association, citing a women-born-women policy. She disputed the ban and the New York Supreme Court ruled in her favor in a landmark decision in favor of transsexual rights. She recently donated the Dunlop tennis racquet she used to win the 1963 All-Navy Championship and the 1964 New York State Men’s Championship, playing as Richard Raskin. Included in the donation are a high school trophy, ophthalmology loupes, a hat, red silk dress, shoes and an autographed photo of Martina Navratilova.
Recent Donations
The Museum also acknowledged a number of recent donations, including more than 100 images from photographer and Washington, D.C., native Patsy Lynch, who’s work documents several decades of the struggle for LGBT civil rights; a full run of the newsletter, The Drag Rag by LGBT historian and activist Mark Meinke; and 86 photographs from Cuban American photographer Silvia Ros who has documented the LGBT community for more than a decade.
These donations join the museum’s collections of more than 3 million objects and archival materials. The museum’s LGBT collections date back to the 19th century. Objects in the collections include a selection of protest signs from gay civil rights activist Frank Kameny, materials relating to the military’s Don’t Ask, Don’t Tell policy, Billie Jean King’s tennis dress and HIV and AIDS-related lab equipment and medications. The archival collections are rich in ephemera, oral histories, photographs, posters and entertainment publicity materials. The museum has also collected materials that express opposition to LGBT issues, including protest posters associated with the Westboro Baptist Church, a copy of The Anita Bryant Story and materials in opposition to gay marriage.
The museum has mounted various LGBT history displays throughout the years, including two marking the 25th and 40th anniversaries of the 1969 Stonewall riots in New York City, generally considered the beginning of the public gay rights movement in the U.S.; an exhibit on the 30th anniversary of the emergence of the HIV and AIDS epidemic; and a display during the 10th anniversary of the AIDS Memorial Quilt.
Through incomparable collections, rigorous research and dynamic public outreach, the National Museum of American History explores the infinite richness and complexity of American history. The deliberate targeting of journalists by the police in Ferguson reveals a desire by government to dissuade renegade alternative journalists as it moves to dominate and politicize the narrative.
Ferguson also provides a stage for the implementation of martial law, especially if the protests and provocateur violence spreads to other cities. A race and class war artificially promoted by the usual suspects, hyped by the corporate media with its politically correct bias, and provocateured on the streets by the FBI and the DHS does not help the poor and disenfranchised. It provides a pretext for additional militarization of police and a further erosion of liberty.

Some in Ferguson, MO are celebrating federal control of the situation, not realizing that it is the federal government that equipped and trained the riot police and reportedly is working with the New Black Panthers, Nation of Islam and others who have previously been federal informants, snitches and COINTEL agents. Is the Federal government working both sides to escalate the situation? A new document illustrates yet again that the government plans to shoot with snipers, the leaders of unarmed, peaceful demonstrations.

With the National Guard now being sent to Ferguson, Missouri as the unrest extends into a second week, questions are being asked as to whether provocateurs are being used by authorities to stage violence in order to justify the militarized police crackdown.
Trouble flared once again last night as demonstrators threw molotov cocktails at police officers while cops deployed tear gas and rubber bullets before the midnight curfew even came into effect. Numerous reporters said they were threatened with violence and arrest by cops if they didn’t leave the area.
Despite the fact that some of the violence and looting is obviously being carried out by criminal opportunists and frustrated locals, many are beginning to question whether agent provocateurs are being used to demonize peaceful protesters and create a justification for heavy-handed police tactics.
Corporal Justin Wheetley of the Missouri State Highway Patrol last night blamed “outsiders” for the mayhem, with KMOV reporting that the trouble was, “stirred up by influences from outside of Ferguson.”
Radio host Dave Hodges also claims to have spoken to a source from within the Department of Homeland Security who told him that violent rioting and looting, “was encouraged and exacerbated by undercover DHS agents posing as members of the Black Panthers.”
“In the past five days I have been contacted, via one of my most trusted sources, a member of DHS, who is opposed to the events and DHS involvement in Ferguson, Missouri. This source stated that DHS is running the Ferguson Police Department and that their actions are designed to antagonize and to provoke the locals to violence. He further stated that he believed that the ultimate goal is to inflame the local citizens to such a point martial law will be declared,” writes Hodges.
Indeed, video footage of a member of the New Black Panthers leading a chant which calls for the death of Darren Wilson, the officer who shot 18-year-old Michael Brown, confirms that individuals from the militant group are intent on radicalizing the demonstrators.
As we reported last week, Hashim Nzinga, the leader of the New Black Panthers, also staged a bizarre scene at the Ferguson Fire Department during which he accused President Obama of being from Kenya.
Members of the New Black Panthers have been caught working undercover for the federal government in the past, with the most recent example being Richard Aoki, who was outed as an FBI informant in 2012.
A key question surrounding the police response to the unrest has been why law enforcement officers were ordered to stand down during looting on Friday night. During the first night of looting on Sunday last week, cops were also completely AWOL.
Whereas militarized police have been out in force to intimidate and target peaceful demonstrators and members of the press, they have failed to respond to the very same looting that has been used as a justification for their crackdown.
“Why did the police in Ferguson refuse to do their jobs?” asks Michael Snyder. “Who told them to stand down? Someone in the mainstream media needs to start asking some of these hard questions.”
The fact that the U.S. Army was conducting martial law training in St. Louis two years has also aroused suspicions.
The presence of provocateurs during riots and unrest is by no means a new phenomenon.
Following the SPP protests in Canada back in 2007, Quebec provincial authorities were forced to admit that three rock-wielding black mask-wearing “anarchists” were in fact police infiltrators used to gather information on protesters.
During the G20 Summit in Pittsburgh in 2009, police also dressed up as anarchists in an attempt to infiltrate protesters.
Alex Jones’ film Police State 2: The Takeover also exposed how the black bloc anarchists were completely infiltrated and provocateured by the authorities during the violent 1999 WTO protests in Seattle.
Numerous observers of the unfolding situation in Ferguson are also starting to ask hard questions about whether provocateurs are responsible for at least some of the violence.

As reported by Fox News, “Texas Gov. Rick Perry was indicted Friday for allegedly abusing his veto power during a dispute with a public corruption prosecutor over her drunken driving arrest. The indictment came down late Friday, after a special prosecutor spent months calling witnesses and presenting evidence that Perry broke the law when he threatened to veto $7.5 million over two years for the public integrity unit, which is run by Travis County (home of Austin and the most liberal country in the state) District Attorney Rosemary Lehmberg’s office. The governor wanted Lehmberg, a Democrat, to resign after she was arrested and pleaded guilty to drunken driving in April 2013. When she refused, Perry vetoed the money. Governor Perry is the first Texas governor to be indicted in nearly a century.”
